1. Who we are
This Privacy Policy explains how KSMC Laboratories SRL, 5 Place du Champ de Mars, 1050 Brussels, Belgium, VAT BE 0825.580.064 (“KSMC”, “we”, “us”) processes personal data when you use ksmc.eu, create an account, place an order, contact us, subscribe to communications or otherwise interact with our website. Contact: info@ksmc.eu.
2. Data we may process
Depending on how you use the Site, we may process identification and contact details, billing and delivery information, account information, order and transaction data, communications with customer service, newsletter preferences, technical and security data such as IP address and device/browser information, and information generated through cookies or similar technologies where applicable.
Please do not send health or other sensitive personal data through ordinary website forms or live chat unless specifically requested through an appropriate secure process.
3. Why we process personal data
We process personal data where necessary to perform a contract or take steps at your request, including managing orders, payments, delivery, returns, refunds and customer accounts; to comply with legal obligations, including accounting, tax, consumer-protection and fraud-prevention obligations; for legitimate interests such as website security, service improvement, customer support and the protection of our business; and, where required, on the basis of your consent, including certain marketing communications and non-essential cookies or similar technologies.
4. Orders and payments
When you place an order, we process the information needed to manage the purchase, payment, delivery, customer service, returns and legal obligations associated with the transaction. Payment information may be processed by the payment method you select at checkout, including payment service providers integrated with WooCommerce. KSMC does not require you to provide payment-card details by ordinary email or contact form.
5. Delivery and fulfilment
Where necessary to fulfil an order, relevant delivery information may be shared with logistics, fulfilment and transport providers involved in delivering your purchase.
6. Customer accounts
If you create an account, we process the information necessary to provide and secure that account, display order information and manage account-related services. You are responsible for keeping your login credentials confidential.
7. Contact forms and customer service
When you contact us, we process the information you provide in order to respond, manage your request and keep appropriate records. The Site uses Contact Form 7 for website forms and may use anti-spam and security controls, including Google reCAPTCHA.
8. Live chat
The Site may provide live-chat functionality through Tawk.to. If you choose to use live chat, information you submit and technical information necessary to operate the chat may be processed through that service. Do not submit sensitive health information through live chat.
9. Email communications
The Site uses MailPoet for email and newsletter functionality. Where required by law, promotional electronic communications are sent on the basis of consent or another lawful basis permitted by applicable law. You can unsubscribe from marketing communications using the unsubscribe mechanism provided in the message. Transactional or service messages relating to an order or account are not marketing communications.
10. E-commerce and payment providers
The Site is operated with WooCommerce and currently includes integrations supporting payment methods such as Stripe, PayPal, WooPayments and Klarna. The provider actually involved depends on the payment option you select and availability in your market. Those providers may process personal data as independent controllers or processors under their own privacy information where applicable.
11. Advertising and commerce integrations
The Site includes integrations for services such as Google Listings & Ads, Pinterest for WooCommerce and TikTok for WooCommerce. These integrations may process technical, commerce or interaction data when enabled and, where legally required, only after the relevant consent has been obtained. Availability and activation may vary by page, market and configuration.
12. Cookies and similar technologies
The Site uses technologies necessary for functions such as shopping-cart operation, checkout, account login, security and language preferences. Other technologies may be used for measurement, advertising, social-media or personalisation purposes where enabled. Where consent is legally required, non-essential technologies should not be activated before the required choice has been made. You can also control cookies through your browser settings. Cookie availability can change as website services and integrations evolve.
13. Security and fraud prevention
We use technical and organisational measures intended to protect the Site and personal data against unauthorised access, alteration, disclosure or loss. The Site currently uses security and anti-abuse tools including Wordfence and Google reCAPTCHA. No internet service can guarantee absolute security.
14. Who may receive personal data
Personal data may be made available, only where necessary, to KSMC personnel and authorised service providers supporting hosting, website operation, e-commerce, payments, communications, security, customer service, logistics, professional advice and legal or regulatory compliance. We may also disclose information where required by law or a competent authority.
15. International transfers
Some technology or service providers may process data outside the European Economic Area. Where EU data-protection law requires safeguards for such transfers, the applicable transfer mechanism must be used, such as an adequacy decision or approved contractual safeguards, as relevant to the provider and processing concerned.
16. How long we keep data
We retain personal data only for as long as necessary for the purposes for which it was collected and to meet applicable contractual, accounting, tax, consumer-protection, dispute-resolution, security and other legal obligations. Retention periods therefore vary according to the category of data and the context. Data that is no longer required is deleted or anonymised in accordance with applicable requirements and operational procedures.
17. Your data-protection rights
Subject to the conditions of applicable law, you may have the right to request access to your personal data, rectification, erasure, restriction of processing, data portability, and to object to certain processing. Where processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing before withdrawal. You also have the right not to be subject to a decision based solely on automated processing where the conditions of the GDPR apply.
18. Exercising your rights
To exercise a data-protection right or ask a privacy question, contact info@ksmc.eu. We may need to verify your identity before acting on a request. We will handle requests in accordance with the time limits and conditions provided by applicable law.
19. Complaints
You have the right to lodge a complaint with the competent data-protection supervisory authority. In Belgium, this is the Data Protection Authority / Autorité de protection des données / Gegevensbeschermingsautoriteit. You may also contact us first so that we can try to address your concern.
